What Evidence You Need for Insurance Claims


A contested insurance claim without camera footage is a claim that often settles at 50:50 liability regardless of what actually happened. This is a well-documented reality in commercial fleet claims: when a third party disputes fault and no objective evidence exists, insurers frequently split liability to avoid the cost and uncertainty of litigation. For fleet operators, this means paying excess, losing no-claims discount, and absorbing the indirect costs of a claim that was not your driver’s fault. Camera systems change this dynamic — but only if the footage is preserved correctly, retrieved quickly, and submitted in a usable format.

What Happens Without Camera Evidence

Fleet managers who review their first full year of near-miss data after installing a camera system consistently report the same surprise: the number of events they thought were their fleet’s fault, which the footage showed were not. Before camera systems, a third party calling an incident a 50:50 had a reasonable chance of success. After a camera system, the footage is either conclusive or it isn’t — and conclusive footage in your favour closes a dispute within days rather than months.

The financial case is straightforward. A disputed claim that settles at 50:50 may cost the fleet operator 50% of the third party’s repair costs plus excess plus premium impact. A claim resolved conclusively in your favour — because footage shows the third party pulled out without warning — costs the excess only, or nothing if you can recover it. Across a fleet of twenty vehicles over five years, the difference in claims cost between evidenced and un-evidenced incidents is substantial.

What Insurers Actually Want to See

UK commercial fleet insurers typically require the following documentation for a claim submission. The weight each element carries depends on whether the claim is disputed:

  • Driver statement — a written account from the driver covering what happened, road and weather conditions, speed at the time of the incident, and what actions were taken. This should be completed within hours of the incident, not days. Memory degrades quickly and discrepancies between an early statement and a later court account create credibility problems.
  • Scene photographs — photos from multiple angles of all vehicles involved, showing the position of vehicles relative to the road, the point of impact, visible damage, road markings, signage, and any hazards. GPS metadata in photograph files provides location and timestamp evidence. Photographs taken on a mobile phone from the scene are the minimum; a camera system that records continuously provides a complete record of the approach to the incident, not just the aftermath.
  • Third-party details — name, contact number, vehicle registration, insurance details, and insurer name from every other party involved. This is a legal requirement, not just best practice. If a third party drives away, the dashcam footage of their registration is often the only way to identify them.
  • Witness contact details — name and phone number for any independent witness. A witness who saw the incident from outside any vehicle is a strong corroborating evidence source if the footage alone is contested.
  • Police reference number — if the incident is reportable (injury to a person, animal, or certain road users), a police reference number confirms that the incident was properly reported.

Camera Footage: What Makes It Useful

Not all camera footage is equally useful in a claim. Insurers and solicitors assess footage on several criteria:

  • Date and time stamp — footage without a reliable timestamp is harder to submit as evidence. MDVR systems embed GPS-derived timestamps that are consistent and audit-trailable. A camera that relies on an internal clock that has drifted, or that shows the wrong date because it was never configured, undermines the evidential value of the footage.
  • GPS location data — footage showing the vehicle’s position on a map at the moment of the incident confirms that the vehicle was where the driver said it was. It also shows approach speed, which is relevant in incidents where the third party claims the commercial vehicle was travelling too fast.
  • Forward-facing view — the most commonly used footage type in claims involving following-distance disputes, junction incidents, and pull-out collisions. A forward-facing camera shows what the driver could see in the seconds before impact.
  • Rear-facing view — critical for rear-end impact claims where the third party claims your vehicle stopped suddenly or reversed into them.
  • Nearside and offside cameras — for junction incidents, lane-change disputes, and pedestrian or cyclist interactions. The footage from a side camera can show the exact position of a cyclist at the moment a left turn was initiated — the difference between a claim that is your driver’s responsibility and one that is not.
  • Driver-facing camera — evidence of driver state and behaviour in the seconds before the incident. Relevant if the third party claims distraction, phone use, or fatigue. Also relevant in cases where the insurer questions whether the driver was following safe driving procedures.

Telematics Data as Supporting Evidence

Camera footage records what was visible. Telematics data records what the vehicle was doing. The combination is stronger than either alone:

  • Speed at time of incident — corroborates or contradicts the driver statement and the third party’s account. If a third party claims your vehicle was travelling at 50 mph in a 20 mph zone and telematics shows 19 mph, the claim is resolved.
  • Braking data — the g-force record from the MDVR or telematics unit shows when hard braking events occurred and their severity. Useful in following-distance claims and emergency stop incidents.
  • Route and position history — GPS route data confirms the vehicle’s exact position at the time of the incident. Useful when a third party makes a claim that the incident occurred at a different location to where your driver recorded it.
  • Engine and ignition data — confirms the vehicle was moving, stopped, or in a specific state at the time of the incident. Relevant in claims where the third party asserts the vehicle was stationary (e.g., a claim that your reversing vehicle reversed into their stationary car).

Preserving Camera Footage Correctly

The most common evidence failure in fleet claims is not the absence of a camera system — it is the footage being overwritten before it is retrieved. A system that records on a loop will overwrite older footage as new footage is created. If the incident is not flagged and the footage not extracted within the overwrite window, it is gone.

Fleet managers consistently raise this as a gap in their process: the incident happens on a Tuesday, the driver mentions it on Thursday, the fleet manager requests the footage on Friday — and the MDVR has already overwritten it. The practical solutions:

  • Event-based recording triggers — a g-force event above a set threshold automatically locks the footage clip containing the incident, preventing it from being overwritten. This is the most reliable protection against accidental loss.
  • Cloud upload on trigger — MDVR systems with live connectivity upload triggered clips to a cloud server automatically. The footage is preserved remotely even if the vehicle is in an accident that damages the MDVR unit.
  • Manual extraction SOP — a defined process for drivers to report incidents immediately and for fleet managers to trigger a footage extraction request within hours. Not all incidents trigger the g-force threshold: a pedestrian who places their hand on the vehicle during a dispute, or a near-miss where no impact occurred, will not auto-trigger but the footage may still be relevant.

GDPR and Footage Submission

Camera footage from a commercial vehicle is subject to GDPR where it captures identifiable individuals. Fleet operators who use in-cab or external cameras are data controllers and must have a compliant data retention policy, a legitimate interest basis for the recording, and a process for responding to subject access requests. This does not prevent the footage being used in insurance claims — legitimate interest and legal claims are recognised bases for processing. It does mean that footage should be retained only as long as operationally necessary and that the existence of the camera system should be disclosed to drivers.

For submission to insurers, footage showing third parties and pedestrians is routinely provided in claims. Insurers are familiar with handling this type of data. The key requirement is that you can demonstrate the footage was obtained lawfully — which means the recording system was disclosed (signage on the vehicle), data is handled according to your privacy policy, and the footage has not been altered.

Within hours, not days. MDVR systems recording on a loop may overwrite footage within 24–72 hours depending on storage capacity and recording resolution. Even systems with event-based clip locking should have footage manually verified and backed up as soon as the incident is reported. If your system has cloud connectivity, the automatic upload triggered by g-force events provides the safest baseline.

Does dashcam footage always help in a claim?

Not always. Footage that shows your driver was at fault — following too close, failing to observe a junction, phone in hand — can work against you. Insurers have a duty of cooperation obligation, which means you may be required to submit footage even if it is unhelpful. The correct response is not to avoid cameras but to use the footage proactively: near-miss events captured by the system are training opportunities that reduce future incidents.

Can a third party request footage under GDPR?

In practice, this right is limited by the rules on exemptions for legal claims: footage relevant to a current or anticipated claim can be withheld pending legal proceedings. Your insurer and solicitor will advise on what to release and when during active litigation.

Is telematics data admissible in court?

Yes. Telematics data from a GPS and vehicle data unit is admissible as documentary evidence in civil proceedings in the UK. The key requirements are that the system was functioning correctly, the data has not been altered, and it can be authenticated by the provider. What if our vehicle camera system was not recording at the time of the incident?

If the system was not recording — due to a power fault, full storage, or a system failure — the claim proceeds without camera evidence. Document why the system was not recording and what corrective action has been taken. Insurers may ask about the operational status of the camera system as part of the claim.
