Evidence Footage for On-Site Incidents


In the 48 hours after a serious vehicle incident on a construction or quarrying site, the footage from every camera on every vehicle that operated near the incident location is either preserved or it is lost. The MDVR‘s rolling storage cycle does not pause for an investigation. If no one identifies and flags the relevant clips, they will be overwritten on the rolling deletion schedule — and the most important evidence in any subsequent RIDDOR investigation, HSE inspection, or civil claim will not exist.

Evidence footage from on-site vehicles is increasingly the central piece of evidence in fatal accident investigations in the extractive and construction industries. Getting it right means knowing what to preserve, how to preserve it, and what the investigation process will do with it once it is provided.

What Evidence Footage Needs to Cover

An incident investigation — whether by the HSE, the coroner, or a civil litigant — will seek footage from multiple perspectives, not just the vehicle involved in the incident. The relevant footage may include:

  • The vehicle directly involved: All camera channels — not just the angle facing the incident direction. A tipper truck that struck a pedestrian in the reversing zone will have the incident on the rear camera; the nearside camera may show the pedestrian’s approach trajectory; the driver-facing camera may show the driver’s attention state.
  • Other vehicles in the operating area: Any vehicle that was within 100 metres of the incident location during the relevant time window may have camera footage showing the approach to the incident, the incident itself from a different angle, or the actions of other workers in the area.
  • The period before the incident: Investigators will want footage from the hour (minimum) before the incident, not just the incident moment. The pattern of operations, the positioning of workers, the approach path of the vehicle — all are established by pre-incident footage.
  • The site access and egress footage: For incidents involving vehicles arriving on or departing from site, access road or gate camera footage may establish when a vehicle arrived, in what condition, and whether any pre-incident contact or instruction was given.

The Preservation Timeline

Footage preservation must happen faster than the rolling deletion cycle. Practical timeline:

Within 1 hour of the incident: Identify all vehicles that were operating in or near the incident area. Instruct their operators to bring the vehicles to a secure location. Do not turn off the MDVRs — some units complete write cycles on shutdown and footage may be lost if the unit is powered down abruptly.

Within 4 hours: Physically secure the MDVRs — either by locking the vehicles to prevent use, or by removing the storage media and replacing it with new media so the originals can be preserved.

Within 24 hours: Review all preserved footage to establish which clips are relevant. Make copies to a secure secondary medium (USB drive, external hard drive, cloud folder with access controls) and document the chain of custody — who copied the footage, from which device, at what time, and in what format.

Provide to investigators promptly: HSE inspectors attending the site will request footage. Having it available, in a format they can immediately view, significantly affects the investigation’s initial direction. An operator who cannot produce footage promptly raises immediate questions about whether adequate controls were in place.

RIDDOR and HSE Investigation Requirements

Reportable injuries and dangerous occurrences on quarry and construction sites must be reported to the HSE under RIDDOR. Fatalities require immediate reporting; specified injuries require reporting within 10 days. In practice, the HSE inspector will attend the scene, often within hours of a fatal incident.

During the HSE investigation, footage will be formally requested. The request typically covers all camera footage from vehicles operating in the vicinity, MDVR event logs, and any safety system records (proximity sensor activation logs, driver alert records). Failure to produce footage that should have existed — because it was not preserved — is itself a finding of significance in the investigation.

The legal framework is the Police and Criminal Evidence Act 1984 for criminal investigations, and standard civil disclosure rules for civil claims. In HSE prosecutions under health and safety legislation, footage is typically disclosed by the defendant operator and examined for evidence of the control measures that were or were not in place at the time.

Civil Claims and Insurance Investigation

Civil claims following on-site vehicle incidents — personal injury, dependency claims from fatalities, property damage — are typically filed months or years after the incident. The footage must survive this period. Standard MDVR rolling retention (30–60 days) is entirely inadequate for litigation purposes.

Once a claim is anticipated — following any serious incident, not only after a formal claim is received — footage should be preserved for the duration of the matter. Personal injury claims under the Limitation Act 1980 can be brought up to 3 years from the date of injury. Dependency claims (following a fatality) can be brought up to 3 years from the date of knowledge. The footage must survive the entire limitation period unless the matter is formally settled or dismissed.

Insurance investigation is a separate process from legal proceedings. Insurers will request footage as part of the claim assessment — and footage that exonerates the operator from fault (showing the incident was staged, or that the worker entered the hazard zone despite the vehicle’s warnings being active) can be the difference between a defended claim and a seven-figure settlement.

Chain of Custody for Footage Evidence

Footage that is disputed — by the claimant’s legal team, by the HSE, or in a coroner’s inquest — requires a documented chain of custody to be admissible as evidence. The chain of custody should record:

  • The original storage medium (MDVR unit serial number, SD card or hard drive identifier)
  • The date and time the footage was copied, and from which device
  • Who made the copy, and in what capacity (site manager, HSE inspector, insurer’s investigator)
  • The format of the copy and the software used
  • Where the copy is stored and who has access to it

Footage that has been transcoded (converted to a different format), edited, or compressed since its original capture requires explanation. Courts and HSE investigators prefer original file formats from the MDVR with embedded GPS and timestamp metadata intact.

Frequently Asked Questions

How long should we retain footage after a serious incident?

Until the matter is fully resolved — including any appeal, review, or limitation period that has not expired. For a fatality, this means retaining all relevant footage until the coroner’s inquest is concluded, any HSE prosecution is finalised (including appeal), and any civil claim has been settled or time-barred. In practice, this can mean retaining footage for 5–7 years from the incident date. The footage should be stored in its original format, with GPS and timestamp metadata intact, on at least two separate media types (on-site server and off-site cloud or physical backup).

Can the HSE compel production of MDVR footage?

Yes. Under the Health and Safety at Work Act 1974, HSE inspectors have powers to require the production of information, documents, and records relevant to a health and safety investigation. MDVR footage and event logs are within scope of these powers. Failure to comply with an inspector’s requirement is an offence. In practice, most operators cooperate with HSE footage requests — withholding footage from a fatal accident investigation creates additional legal exposure beyond the original incident.

What if the MDVR was damaged in the incident?

Physical MDVR damage in an incident is a common scenario on quarrying and construction sites. MDVR data recovery from a damaged unit is possible in most cases where the storage media itself (hard drive or SSD) is intact. Specialist data recovery services can recover footage from MDVRs with physical damage to the housing, power supply, or interface circuitry. Cloud upload of triggered event clips is not currently offered, so prompt physical preservation of the storage media after an incident is the reliable way to protect the footage.

Should we provide footage to the claimant’s solicitor before receiving a formal request?

This is a legal question specific to the facts of each matter. Legal advice should be sought before any footage is disclosed to any third party — including the HSE — following a serious incident. The general principle is that footage beneficial to the operator’s position (showing no fault, or showing that controls were in place and active) should be preserved and may be disclosed proactively when it will terminate a claim efficiently. Adverse footage must be disclosed in accordance with legal obligations in civil proceedings. The worst evidential position is footage that was not preserved and cannot be produced — that absence is itself a significant adverse fact.

What is the difference between MDVR event logs and camera footage for investigation purposes?

MDVR event logs record sensor and system events: proximity sensor activations with timestamps, G-sensor triggers, driver alert acknowledgements, and system health events (camera offline, power interruptions). These logs provide a structured, timestamped record of the vehicle’s safety system behaviour around the incident time. Camera footage provides the visual record. Both are important: the event log may show that a proximity sensor activated 3 seconds before the incident (establishing that the detection system was working and the incident occurred despite detection), while the footage shows what the sensor detected and what happened next. The combination is more complete than either alone.
